Sir we need help. Kasi we have this common friend who happened na mahilig umutang pero hindi nag babayad. We were suprised na marami na rin pala siyang nautangan (including me) sa mga kaibigan namin na lagi nyang pinangangakuan na magbabayad sya pero di naman nababayaran (months and years in some cases). Gusto ko lang po itanong kung may may habol po ba kami since wala naman kaming any written agreement at puro verbal lang. Wala kaming solid evidence. We really need your advise. Thankyou for your help and attention!

try first to send a demand letter, then a complaint at the bgy, and then a small claims case. rules on sc.judiciary.gov.ph. it will be entirely up to your credibility if you will be believed by the judge.

Thanks Attorney! This is great.ummm sir I forgot to give you much more details. Actually that friend of ours is our team leader and the friends Im mentioning were team members. Should we just call the attention of our HR? then If nothing happened, then we might just go directly to the barangay. What case should be file just incase? does this incident falls under the revised penal code Act No. 3815 as a estafa case? thanks again in advance! more power!

Hihingi po sana ako ng legal advice.

Posible po bang ireklamo ng isang dating OFW (matapos ang kanyang contract, nakabalik na ng Pilipinas, lumipas na ang 12 years) ang recruiter nya dahil sa di pagsauli ng mga sinubmit nyang documents nun sa pag-apply nya sa trabaho sa abroad? Tulad ng college transcript of records, certificate of employment. Ito po kasi inirereklamo samin. Illegal recruiter daw po kami.

Required po ba na ibalik yung mga papers na un sa mga applikante? Sarado na po yung agency pinagsubmitan ng mga requirements nun lalo na 12years ago na. Valid ba sya sumingil ng pera dahil sa pagkawala ng mga papeles nya? May pinirmahan daw po kasi syang BOND na worth 20, 000 para sa mga papeles nya na ibabalik ang 20, 000 pag nawala o hindi binalik sa kanya ang mga papeles nya.

Saka po posible po ba magbigay ang aming barangay ng Certificate to File Action sa taong ito na hindi nakatira sa aming barangay? At ayaw pong sabihin kun san sya nakatira. Tama po ba na magreklamo sya kung wala naman syang valid evidence na may agreement na dapat ibalik ang mga papeles nya at may bond nga na 20,000.

Based po sa hearing sa Barangay, lumalabas po sa mga sagot at pananalita ng babaeng ito sya po ay may diperensya sya sa pag-iisip. At mukhang gusto lamang mangawarta.

Ano po ang dapat namin gawin? Malaki pong purwisyo ang binibigay samin ng babaeng ito.

Ano po itsura ng Certificate to File Action? May pinapirmahan po kasi sa tatay ko na maliit na papel na sulat kamay ng taga Barangay. Ibibigay daw un sa babae para matigil na un pagdakdak dun sa Barangay. Ang nabasa ko po dun eh acknowledgement ng presence ng both parties tapos certify to file action. Napapirma po agad ang tatay ko dahil sabe nun nag-iinterrogate/pamagitan eh para lang daw matigil un babae at wala daw saysay un papel na yun. tapos po di kami binigyan ng copy at pinauwi na kami.

who has the papers? if it has been 12 years, i don't think their case will prosper. normally a cfa is a one page document stating that a confrontation was held and no settlement was reached.

hello po.. thank you po sa pagreply. tinatanong po ng Barangay interrogators sa kanya asan yung BOND pero wala syang mapakitang BOND na pirmado. kini-claim po nun babae na nasa mother ko daw po yung papers.. as in lahat ng papers. Importante daw sa kanya un mga documents nya kaya kinukuha na nya pag wala daw mabalik sa kanyang papers kukunin daw nya yung 20,000 na BOND.

sabe po ng Barangay tutulungan nln syang request yung mga papeles nya sa school nya at pinagtrabahuhan nya. kaso ayaw po makipag cooperate.

sabe po ng mother ko wala nmn pong ganon BOND sa recruitment. ang meron lang is processing fee.

Posible pa din po ba magbigay ang Barangay ng Certificate to File Action kung wala naman pong basis yung ni-cclaim or nirereklamo samin nun babaeng yun? Na kahit po un mga interrogators nagsasabe na samin na hindi valid un nirereklamo samin.

Last question po, ano po magiging ending nun 1st hearing? kasi po wala naman pong pinapirmahan samin na close na un issue.

if no settlement is reached, the bgy should issue a cfa so she can file a complaint at the court.
