Good Evening po.
Gusto ko lang ishare ang mga problema na pinagdadaanan ko ngayon at magbakasakali na makakuha ako ng mga insights sa mga tao d2.

Nagumpisa po yung problema ko ng nahuli ko ulit yung asawa ko na nambababae a month ago. Married kami for 12 years na pero never talaga kami nagsama sa iisang bahay. MEron kaming dalawang anak.8 at 3 yrs old. Dati po akong seafarer pero one year nako na nakabakasyon d2 sa Pilipinas. Before ako nagdecide na umuwi sinabihan ko ang asawa ko na gusto kong ayusin ang buhay naming maganak at mamuhay bilang isang pamilya. nangako sya na nde na sya mambabae at aayusin nga namin until nahuli ko na nman sya at nagdesisyon ako na tapusin na. Gusto kong magfile ng annulment.

isang araw pinuntahan ko sya sa tinutuluyan nyang staff house sa cabanatuan para papirmahin sya ng waiver of rights para maisalin ko sa panganay kong anak ang properties na na acquire ko nung nagbabarko pa ako. Dun na nagsimula na naginit ang ulo nya sakin at ayaw nyang pumirma. ang sakin lang nman kahit magasawa kami at inside the marriage nabili ang property alam nman nya na wala syang binigay kahit piso sa mga yun. kaya gusto ko lang masafe sa anak na nmin ipangalan since wala pa nmang title. Gumulo n ng gumulo at nakisali pa ang tiyuhin nya sa usapan hanggang sa nagkagulo na at bigla nlang akong sinapak ng tiyuhin nya ng 4 na beses sa me kilay ko. Sinampahan ko po ng Physical Injury ang tiyuhin ng asawa ko. Pero nung una sinasabi ko pa sa kanya na akkalimutan ko ang nangyari kung magwewaive sya ng rights. After ng incident na yun never na sya nakipagcommunicate sakin.

A week after naabutan ko sya sa office ng binili kong lupa at napagalaman ko na knukuha nya ang lot description. Wla kasi sya kahit anong papeles na pinanghahawakan. ang alam lang nya me lupa ako dun. at ngayon gusto nyang kunin ang kalahati ng lupa na yun. kaya po nagaway kami at nagsigawan tas tnutulak nya ko kaya nasampal ko sya tas biglang lumapit yung tiyahin nya at hinablot ako at kinalmot nung tnulak ko sya lumapit ang asawa nito at dinagukan ako sa ulo at pinagsusuntok sa braso at likuran. nung aawat yung nanay ko biglang sinipa ng tiyuhin nya at nagkaron ng black eye sa kanang mata. Sobra na po sila. Kinasuhan ko ang asawa ko ng 9262 at ang mga kamaganak nya ng physical injury.

ang tanong ko po. ngayon na me mga kaso akong ganito. makakahadlang ba to sa pagaabroad ko. one year nako d2 at nangangailangan na din akong magtrabaho lalo ngayon na kahit singko wala na syang ibbgay na suporta sa mga anak ko.
gano po ba katagal ang mag kasong ganito tulad ng physical injury at 9262? ang alam ko po kinasuhan din nila ako ng physical injury at oral defamation ata..nde ko pa alam kasi wala pang summon na dumadating sa amin. panibagong kaso po ba ito o prang counter lang sa kasong sinampa ko? sa piskalya lang po ako ng file unlike nila na me sariling abogado.
kung sakali pong matapos man lahat sa korte [ walang me gusto ng settlement] malalagay ba ang mga bagay na to sa nbi at makakahadlang na makahanap ako ng trabaho?

Gusto ko po sana makapagfile ng sole custody ng mga bata. pano ko po ba gagawin ito. at me laban po ba ako kung saka sakali. yung mga anak ko po simula pag kapanganak sa mommy at daddy ko lumaki. nasa puder namin sila. ang problema ko kung makakapag abroad bako mapupunta na kagad ang mga bata sa kanya?

at yung huli po yung sa lupa ko wala po bang pagkakataon na mailipat ko sa mga anak ko ang lupa ng nde sya pipirma? ako po ang principal buyer kaso nadeclare ko na married ako pero ng binili ang lupa merong SPA para sa mommy ko na nakapirma kaming dalawa. nakasaad sa SPA ang full power para sa mom ko like sa article 6. nakalagay na pede nyang ibenta o paupahan ang naturang lupa.

nawa po'y me mkapagbigay man lang sakin kahit konting advise. Sobrang hirap ng pinagdadaanan ko sa ngayon. salamat po

gud am poh. itatanung ko lang poh sana kung anung pwede kung gawing hakbang. nagsama po kami ng asawa ko for 6yrs at di kami nagkaanak, iniwan nya po aq kc sumama sa iba. pero kasal po kami ng legal. nag kahiwalay kami at nagpakasal po xa sa iba pero ang gamit nyang name ay ganun pa rin pero iba na spelling like raoul III naging raul jr. aq naman po ay nagkaanak sa iba. gusto ko lang sanang ma legalized yong hiwalayan namin para maging malaya din aq, dala dala ko pa rin apelyido nya taz xa may pinakasalan ng iba.

serena, those properties are co-owned by your both and you cannot dispose of them without his consent.

cases take years. it is possible for them to request a 4 month watch list order against you.

you can file a case for legal separation so that the properties and the custody will be awarded to you.

ano po yung watch list order?
sa Legal Separation po ba me pagasa na makuha ko po ang mga lupa na pinundar ko?
Tsaka po yung isang lupa namin nde pa po tapos bayaran yun..meron po ba akong hakbang na pedeng gawin para pagbayarin sya sa kulang sa lupa or pede ko ba sya ipatanggal as owner since ngayon na magkahiwalay kami e wala nman syang binibigay saking pera.
Nagfile na po ako ng Annulment..dapat po ba Legal Sep muna?

Ask ko lang po, pwede bang irepresent ng boyfriend ko ang sarili nya sa court petitioning for the nullification of his marriage since his wife is already married in Canada and they have been divorced for 9 years now. He has the divorce paper and marriage certificate.

One more po, yung anak ko ay hiwalay sa asawa for 9 years na at may 11 year old silang anak. Nagfile ng violence against women and children ang manugang ko i think 4 years ago. after 2 court hearings, she dropped the case. we found out that she's heavy with a child to her paramour. Can my son represent himself using the child's birth certificate for the annulment. My son now is living with his girlfriend. they've been together for 4 years now. I don't want any adultery case for my daughter-in-law or concubinage case for my son. That is also my daughter-in-law's request. can you give us your advice. I had my annulment in 1998.

yung sa annulment ko po kakaibang kaso po never ko pa nakausap yung abogado ko. bale po nagbgay ako ng down hiningan ako ng narrative report tas po wala pakong naririnig sa kanila. pati nga po psych exam wala daw at wala ding appearance at sa tarlac daw po ifile. pede ba yun? nde po kaya ako niloloko lang?

Good morning, sorry if you got confused, in the first problem, my boyfriend is Filipino and he's there in Q.C. and his ex-wife is in Canada. He has a copy of their divorce paper and the marriage contract of his ex-wife to a Canadian. His ex-wife is already married. Can he represent himself for an annulment of marriage by merely presenting his wife's marriage contract with her new husband and their divorce paper?

The second one is for my son, whose wife had a child with another man. They lived together for 2 years after marriage but has been separated for 9 years now. We have no money to pay the lawyers. I know it costs a lot nowadays. When I had my marriage annulled my lawyer just asked me 500 php per appearance and I know nowadays it costs so much. Can they both represent themselves in court or are there pro-bono lawyers around who would accept a cheaper per appearance fee? Thank you very much for your immediate response.

kabet, the divorce is not a basis for annulment, but it can be recognized if it is proven to be valid after a court proceeding. what is important is that the spouse who filed for divorce was not a Filipino at the time the divorce was filed.

again, mere infidelity is not a basis for annulment. i could never endorse a layman to represent himself in the rtc.
