Hi Atty,

Please help me with my friend's delima....

Randolph, Rosely and Samson Jr.are sons/daughter of Samson Sr. outside marriage since he was already been married legally w/4 children.

Now their Lola, mother of Samson Sr, made a Deed of Donation for 3 properties in favor to Randolph, Rosely and Samson Jr. with Virgilia their mother as administrator/guardian since they are 6, 5, and 2 years of age.

Its been decades already since the it was made and they have the original Deed of Donation.

Their Lola is dead and so their father. They want to made the document legal by processing for Land Title but the legal children keeps on bothering them that their Lola had no rights to transfer it claiming it was their Lolo's property.

The tenant of the land continuously give them the proceeds of the harvest.


Can they possibly do the processing of the Land Tile even if it is the only document on hand and what should they do first. Thank you

Lolo past away when Lola made the donation.

They never knew yet if it was Lolo or Lola's name in the Title.

Randolph is just 6 years old when the donation was made. Now he's 30 years old, just recently work for international seaman.

Now he's planning to work on the papers since he can finance for the transfer if possible.

And Yes it has a mother title. The Sister of Randolph's father has it or maybe the legal family asked it from her. But it has a title.

But the tenants of the land can testify that the land was given to them since they were instructed by Lola to give the proceeds to Randolph's family not to her daughter or daughter in law.

Randolph don't know yet if they already process their own title since they were given also vast of land to own from Lola.

Deceased Lolo/Lola is the registered owner of the land.

The legal family claim that it was their Lolo's property and Lola has no right to do the donation. Maybe in the title we can assume that it was Lolo's name.

Randolph's might be the 2nd family but I think they are not illegitimate since Samson Sr. made them as the beneficiaries for his SSS pension when he died as a police officer.

Randolph is just 6 years old when Samson Sr. died, later they knew that they are the beneficiaries when, they have problem on the Family name to bear. It was the document from SSS proved that they can bear the Family name of Samson Sr.



Is it correct to assume that they have also rights with Samson Sr. inheritance property? Eventhough it was Lola who made the donation?
