can my mother has the right to sell property of my father?

My father died may years ago...

My father and his brother has a property (house) got from my grandparents. Kasal na sila ng mother ko nong na MANA nila ito from my grandmother. One of my brother is claiming that my mother has no rights of the house since the said mana (house) is galing sa mana ng father ko. (no respect to my mother). Galit nanay ko dito kasi laging nagnanakaw ng mga gamit. Naaawa ako sa nanay ko since matanda na sya para tratuhin ng ganon.

My question is?

Is my mother has the rights to sell the house with the brother of my father(uncle)? (without consent of the black sheep brother?)

Paano maka ganti ang nanay ko sa pasaway kong kapatid?
