Valid po ba first marriage ko?

Twice po kami ikinasal. The first marriage, mali ang birthdate ng asawa ko since we needed to make her age legal. Nasa NSO po record ng first marriage namin. Then, when she turned 18, we got married for the second time. Which of these two marriages is legal, the one with the wrong birthdate or the second marriage? What should I do to correct this? Thank you in advance..

note, this matter is not settled, and this is just my opinion.

the by the book answer is that both marriages are void. first marriage is void because wife had no legal capacity; second is void because of a prior existing marriage. you would have to annul both marriages and then get married a third time.

the good news is that no one can question your marriage except you and your wife.

Thanx for the reply. And forgive me for being so persistent about this. My real concern really is, I might go to the US for work, and I am hoping to take my wife with me. Will the embassy question the validity of our marriage? I'm sure that the Marriage Cert. will be one of the primary requirements.

i cannot tell what the embassy will do if they find out. technically only the first certificate should be recognized.

if you have limited resources and have no problems with your wife, I would recommend to just leave it alone,primarily because only you or she can question the validity of your marriage.

but as to this US visa petition, I am not competent to answer.

Good evening Sir. I'm back... My wife will be requesting for a copy of our marriage certificate from NSO. Something like a "red ribbon" copy. I'm not really sure. And since we had two marriages, I'm wondering which copy of the marriage certificates will she get. She needs it badly for a dependent visa for China. Tanong ko lang din po ang dapat namin gawin.
Married na po kami ng missis ko civilly and registered at NSO, kaso po since below 18 years old sya that time pinalitan po yung birthdate nya para maging 18. The original birthyear nya was 1974 ginawa pong 1972.

Please give us advice, how to correct this.

i have also the same problem with them my first marriage with my wife.i thought it was a fake marriage because it has an erasure on our marriage contract and the date are also wrong and the address of my wife and surname of her mother are also wrong.after 6 months before i go to canada or before i file my papers i get a cenomar to make sure that i am married or not..but our marriage does not exist so i go to canada with no doubt..now im going home to philippines this september to get married but when my wife get a cenomar for our requirements our marriage its exist. what step should i do for this...i like to petition my wife..should i go for void our first marriage for what reason?thanks for your help i realy appreciate it..

is the person on the marriage your wife now? or is it a different person? did you get married for a second time?

yes sir its still my wife..we will plan to get married this coming september.

the first marriage certificate is considered valid. i don't recommend getting married again because the nso will not issue you a certified copy and will still issue the first one.
