hi, Good day!
May tanong lang po ako about sa Labor Rights.
Pwede ko bang ireklamo ang HR/Payroll o yung manager/supervisor na nag-consolidate ng mga Incentive Forms kung mapatunayang mali o dinaya nila yung amount entry sa Tax ko for Incentives/Prizes? May kaso po ba yun?

I'm a call center agent, taxable po lahat ng mga incentives/prize na nakukuha namin sa work which we are all aware of. Kaso mali ang nilagay na amount sa taxable incentive/prize sa payslip ko.

Ikuwento ko lang ang pangyayari:
Last Jan 14,2011 nanalo po ako sa Raffle contest sa office (BPO company) Sketchers ladies watch (model:Axial white) inalam ko kaagad yung prize nung relo. I went to Megamall a week ago, at nakita ko nga na Php 1,795.00 ung amount. I waited to sign the Employee Incentive Receipt and Acknowledgement Form o (EIRA) pero Feb 09,2011 na nila nabigay sakin para pirmahan at walang amount na nakalagay kundi "(watch)" lang, tiwala naman ako na may copy of receipt silang ipapasa sa Payroll kaya pinirmahan ko na din. At nung Feb 28,2011 payday, nagulat ako na ang naka-declare na Taxable Incentives ko ay worth Php 2,095.00 which I was surprised dahil 1,795.00 lang naman ung relo. I immediately filed dispute to my Team Lead requesting for a copy of receipt, pero umabot ng buwan na walang reply. Kaya ako na mismo nag-email sa Payroll regarding sa complaint ko, kung di ko pa sinabi na --"If there will be no any responds to this, I will directly file complaint to BIR."--eh hindi sila magrereply.
Finoward nila thru email ang lahat ng copy like EIRA Form, xerox copy ng O.R. and other supporting documents sa Team Leader ko. The transaction date was Dec 31, 2010, nasa resibo ay 4 na items ung binili nila dun sa SM Taytay.
2 items for men's watch worth 2,095.00 at 1 item for ladies watch worth 1,795.00 ung isa ay express kit worth 150.00 purchase using SM advantage card. Nag punta ako last June 25, 2011 sa SM Taytay para i-verify ung mga purchased items at ipinakita nga sakin ng saleman ung logbook for Dec.30,2010:
1pc Axial white code:70304 -Php 1,795.00 (ung prize ko!)
1pc Blackout blue code:30361 -Php 2,095.00
1pc Blackout red code:30363 -Php 2,095.00 (prize nung isang agent)
Nakita ko na ung Manager ng Dept namin ang isa sa mga pangalan ng naka declare sa Incentive forms na nakakuha ng mga items.
Sa palagay ko, ang ginawa nya kahit worth 2095 ung watch nya eh dineclare nya sa Incentive form ay 1795 + 150 (1,945.00) instead 2,245.00. Meaning to say, he/whoever did the report intentionally switch the right amount to the right person who received those certain items.
I was so upset, kinda Modus Operandi!
There's a BUDGET from Clients every month na dapat nilang ipamigay sa mga agents whether games, outing, or pa-raffle contest, etc.
I observed them that every time na may Team Lunch, activities etc., they obliged us to sign a forms (Incentive), pag tinanong namin para saan they just gonna tell us attendance daw. We need to make it change, rampant na mga ginawa nila pinapasa nila sa mga sahod namin ang mga tax and deductions na dapat sa kanila.
For me, there will be no problem if the amount that shown there was same worth of the item I recieved. I just want them to be fair.

so... they gave you cash instead of the actual item? then probably the difference is the tax. they raised the amount given to you so you could enjoy the whole amount or cost of item.

But that's so strange to hold a raffle and give you the cash value instead. More so since they bought the items anyway.

i also don't see the reason for your complaint - you got more than the P1795. And you haven't shown that there was any switching of prizes either. Maybe the winner of the P2095 prize got more as well to cover the taxes, etc.

hindi po cash..relo po napanalunan ko worth 1,795.00 pero naka declare sa payslip ko naging 2,095.00 na. kung baga they faslcify the documents for the incentives na pinasa nila sa payroll. ganun yung nangyari..

binigyan ka ng relo tapos kinarga pa sa payslip ang amount?
