I would like to ask legal advice regarding my mother's case. My mother allowed my half brother to live at our lot premises. He constructed their house at our lot without any signed agreement or paper. It was all verbally done. But right now my mother and my brother has misunderstanding and lead to a point that my mother wanted them to leave their house within our lot premises, but they're refuse to leave unless we pay them all the cost of construction of their house. They stayed at their house for more than 3 years and they're asking us to pay more than a hundred thousand pesos. I just want to ask kung may karapatan ba silang singilin kami ng ganun kalaki at kung idudulog po ba namin ito sa court ano po ang posibleng karapatan namin dun sa lupa?

oo may karapatan sya maningil kasi builder in goodfaith (pumyag ang mother mo magpatayo sya nang bahay) ang brother mo. PERO yung actual expenses lang sa pagpapatayo nang bahay ang dapat niyo bayaran with depreciation nang value. yung actual expense ang dapat patunayan nang brother mo less depreciation, kayo ang dapat niyo lang patunayan ay ang ownership sa lupa at kontrahin ang evidence nila sa expenses nila.

parehas po ng case namin eto... pero di dahil nagaway sila... kasi kelangan na naming ung lupa.. gagamitin na ng kapatid ko para sa bahay nila..

at hindi po sila nagpatayo.. kumbaga renovate nila ung property na walng pasabi... dating tindahan po un.. tapos ginawa nilang bahay.. dati po kasi silang squatter na nademolish.. pinatira po ng nanay ko ung kapatid nya.. pero we didn't mind.. kasi kelangan nila.. paano po un?

ngaun nanghihingi po sila ng pera na pinanggastos nila dun sa pagpapaayos..
