Rights to property

Good day Sir/Ma'am,

We (with my wife) bought a house and lot around Taytay area. Since this is an end-unit, there is a vacant lot adjacent to it. The vacant lot ends in a creek, hence it is not good to build another house. When I was still negotiating it with the owner, I met the president of the homeowner's association (which the house and lot owner happened to be his friend and kumpare). He did not mention anything about the vacant lot at that time. Now, we have paid the house (and lot) in full. The owner also had left the house so my brother-in-law is the one attending to it. The house is only 50% done. We are now planning to furnish the house. One time, the president of the association visited the vicinity and advised my brother-in-law that we can not touch the vacant lot, but only the house that we bought. The ex-owner of the house built the main door facing the vacant lot but there is still a door at the carport to go inside the house. The president also said that he was planning to build a guard house at the corner of the vacant lot. This is a big problem to me and my family. Most of the members are girls (my wife, daughter, mother-in-law, yaya) and one son (5 years old). Most probably, the security guards that will be assigned will be men. There will be no security for my family at all! I cannot be assured that they won't do anything aside from their duty). I am an OFW and I am always away from home. And thinking that there will be always men walking around outside of our house is a big burden. The president of the association happens to be a general in the military (still in active duty). There are still a lot of vacant lots inside the village and I have no idea why they want to build a guard house near my house.

How can we settle this? Do we have rights to the vacant lot (I don't mean owning it since we do not have legal papers) more than the association?

Who owns the vacant lot, the Developer or the Association? If it is the former, buy the vacant lot. You have a better right to it than the Association, since you own the adjacent lot.

Thanks ibonidarna. I hope you are right. The village was already turned-over to the association. I have not spoken with the association members (or the president) yet, since our schedules don't meet. I totally disagree with their idea (guard house construction near my house). I will try to convince them in a kind manner as much as possible. I have no intention of owning the vacant lot (and I don't know if it is possible to buy it). The other end of the vacant lot is a creek so it is impossible to build another house. I am also not sure if the association know their rights to it (the vacant lot)or if they are only assuming.
