i been charged of estafa at the quezon city rtc, and been waiting for the resolutions by the fiscal.

can someone file another estafa case against me at the other court? and the person who is charging was included in the complaint at qc rtc. and he filed it at the pasig city.

is it a form of forum shopping? and one thing at the investigation data form that person sworn that there was no case filed in the other office. please help with this.

if it arises from the same set of facts, then it is forum shopping. if it's different, then it is not.

atty it's the same, the only difference is that, he's now the major complainant!

i went to to the fiscal, and he told if it's the same then, file a motion to dismiss. but then again atty,under oath he said that the complaint he filed has never been filed nor have a pending at the other office. that's perjury right?

yes, you can also file a motion to dismiss and perjury when he signed the info data sheet. was he also a signatory at the other complaint?
