gud day po,,tnong q lng my case kc ang tatay q sa supplier nya,,worth 1.2M ksama n dw ang interest,,mejo matagal n din un,,2 months ago my ntanggap n subpoena ang tatay q,,tapos nkipag usap xa dun sa supplier n settle ung account at hulog hulugan nlng nya pero ayaw pumayag gus2 nya cash or 100k a month pero nde namin kaya..knausap q din ung supplier pero ayaw nya talaga iurong ang kaso,,hukom nlng dw ang mgpapasya,,naka 3 hearing n dw po ang nakalipas pero nde umaatend ang tatay q,,anu po ang posibilidad n mangyayari at ilag buwan or taon b bago mkkapgdesisyon ang hukom???salamat po

is what you received a subpoena from the prosecutor's office? did your father file his counter affidavit? it is not enough that you just offer a settlement, he should provide a defense against the charge of estafa.

i believe ignoring it is the worst thing he can do especially if he has a defense against estafa. a preliminary investigation can be done in 3 months.

if you do not participate and the prosecutor finds probable cause, a warrant of arrest may be issued against your father.

salamat po..pero po nagtatagal ba ng ilang taon or years ang pagdinig sa ganyang kaso??bago halimbawa mag issue ng warrant of arrest kung for example napatunayan n nagkasala nga po,,kc planu ng tatay ko n ibenta ung bahay sa halagang kailangan na ipambayad sa kanyang supplier,,ng aalala ako na baka mahuli na ang lahat na kung kailan may pambayad na saka naman tapos na ang kaso at nakapag issue na ang hukom ng warrant of arrest..nakakapgpiyensa po ba ang ganyang kaso??

galing po yata prosecutor's office ung subpoena,,pero po wala naman kc natatanggap n sulat na may hearing ng kaso,,kahit isang sulat po,,kaya po hindi siya nakakadalo.

he should go to the prosecutor's office to learn the status of the case.

when a person is accused of a crime, there is first a preliminary investigation so that he is not directly accused in court. during this investigation, a prosecutor determines if there is sufficient evidence to charge your father.

if the prosecutor believes that a crime has indeed been committed and it was your father who committed then the case is filed in court. the court has to agree that there is probable cause to charge your father and that is when the warrant of arrest is issued.

he can file bail so he won't be imprisoned during the trial.

he should try to defend himself at the prosecutor level. there may be defenses available rather than just give up. what if the supplier won't accept your offer to pay?

salamat po ng marami ha..few questions nalang po,eh d ang sasabihin ko po sa tatay ko,ang unang gawin mag submit ng counter affidavit para depensahan nya yung kaso at kumuha ng abogado nya.Halimbawa lang po,pero wag sana mangyari,na napunta sa court yung kaso tapos po during the trial,naprovide ng tatay ko yung halagang hinihingi samin nung nagfile ng kaso,may sapat na kameng halaga pra ibayad sa kanila,posible po ba na maiurong pa yung demanda at bayaran nalang yung supplier??halimbawa lang po na ganun ang mangyari pero pinagppray ko na hindi na umabot sa korte pa..thanks po uli.

during trial, there is a phase called mediation where you can settle. that will be the best time to pay.

after that, even if you have the money, this by itself is not enough. you will need to get the consent of the court, private complainant and the prosecutor.

lhovie, is this a loan agreement with interest? is there a written contract where the rate of interest is stated? how much did you borrow, and how much is the interest, and how much have you paid?

loverose, you should send written notice to the issuer of the checks that they bounced. make sure you have proof that it was received. if you live in the same city or municipality as the issuer, you should first file a complaint at the bgy, then you can initiate a case for collection or criminal case of bp22
