Hi,

I'll be migrating to US within the year and I want to help my niece by adopting her so I may be able to petition her later. I also talked to her father and he already agreed about the plan because it may be their chance also to have a better life and my nice also agreed with it. Although, my niece is asking me if its OK to retain her last name to pay respect to her father. Is this possible? IS this allowed by the US State Department to petition an adopted child that is not using my name?

are you based here in the Philippines or in the USA?

for concerns on US immigration, you ought to inquire in the US.

With regard the name, under philippine adoption law, change of name is allowed but not required.
