atty. mag fofourteen years na kaming hiwalay ng asawa ko,1995 kami kinasal 1997 nahiwalay kami,naiwan yung 1 anak namin na lalaki sa poder ko,tinangka niyang kunin pero di niya tinuloy dahil sa takot din siya na ipakulong ko cla ng kalaguyo niya.Di pa kami totaling hiwalay nun pero nagpabuntis na sya sa iba.Ayoko namang kasuhan siya dahil narin sa anak namin.Ngayon 2 na anak niya sa kinakasama niya.
Year 2006 po nagkaroon din ako ng kalive-in hanggang ngayon nagsasama pa rin kami at 2 na ang anak ko dito sa kalive-in ko.Isang 4yrs.old at 11mos.
Atty.tanong ko lang po pwde po ba niya akong kasuhan kung maisipan niyang maghabol,kahit na siya ang unang gumawa ng kasalanan sa akin?
Pwede niya ba yun gamiting pang blackmail para ako yung gumastos ng annulment namin?pareho naman po namin gusto magpa annul,kaso po wala pa po akong sapat na pera kaya di ko pa maayos.Sino po ba dapat ang magfile ng unnulment namin? O pwede rin po bang paghatian nalang namin ang gastos para maayos na,since may kanya-kanya na kaming pamilya.Pakiramdam ko kasi pag di ako nagshare ng gastos for annulment wala syang balak magfile.hinihingan po kasi niya ako ng 100k share ko dw s pag papa annul namin.
Maramig salamat po sa pagbigay ng oras sa mga katanungan ko.

A marriage may be annulled for any of the following causes, existing at the time of the marriage:

(1) That the party in whose behalf it is sought to have the marriage annulled was eighteen years of age or over but below twenty-one, and the marriage was solemnized without the consent of the parents, guardian or person having substitute parental authority over the party, in that order, unless after attaining the age of twenty-one, such party freely cohabited with the other and both lived together as husband and wife;
(2) That either party was of unsound mind, unless such party after coming to reason, freely cohabited with the other as husband and wife;

(3) That the consent of either party was obtained by fraud, unless such party afterwards, with full knowledge of the facts constituting the fraud, freely cohabited with the other as husband and wife;

(4) That the consent of either party was obtained by force, intimidation or undue influence, unless the same having disappeared or ceased, such party thereafter freely cohabited with the other as husband and wife;

(5) That either party was physically incapable of consummating the marriage with the other, and such incapacity continues and appears to be incurable; or

(6) That either party was afflicted with a sexually-transmissible disease found to be serious and appears to be incurable

almost all of this grounds prescribes after 5 after the marriage.

she can file a petition to get the child if she wants, she can file concubinage, on the other hand you can file adultery, it does not matter who commit the crime first. You can initiate the filing of annulment but i doubt you have a solid ground for annulment and it takes a long time and there is a chance that the petition may be dismissed.

grounds po ba sa annulment kung may isang anak siya sa iba at kahit na pina apelyido nya sa akin 3 po ang anak namin ang panganay at bunso ay tunay kong anak pero ang pangalawa ay anak niya sa iba.isa pa po may agreement na kami at pirmado naminng mag asawa at ang mga cunjugal properties namin ay nahati na at binayaran ko na siya.

you cannot dissolve the conjugal property unless one of the spouses dies, or when you obtain a decree of annulment or legal separation or when you apply for judicial separation of properties. Having a child of the wife from another man is not a ground for annulment, EXCEPT Concealment by the wife of the fact that at the time of the marriage, she was pregnant by a man other than her husband; the law is strict that you have no knowledge that she is pregnant at the time of marriage.
