Tomorrow my wife goes to defend herself at a Barangay hearing for grave oral defamation
Although out of character for my wife, the charge is probably correct but I consider it was a minor argument between two persons who did not previously know each other. My wife is going to be humble and is eager to apologise at the Barangay Hearing, hoping that an early settlement can be made.
The facts are these, I park my vehicle directly outside a store while I go to get a telephone number from someone I see at a cafe on the other side of the road. My wife and baby are in the car and the owner of the store requests that the vehicle is moved from outside her shop. There are no parking restrictions and vehicles are allowed to park. My wife replies that I will be back in a few minutes and then we will move the car.
The shop owner insists it is moved straight away and that we need to ask her permission to park. My wife gets into an argument that she is being too strict and does not own the road anyway. The shop owner says " Your crazy" to which my wife says you are more crazy than me" My wife eventually tells her "go to hell". When I return after five minutes I drive away not wanting to inflame an already heated argument. Two weeks later the shop owner has complained of grave oral defamation. It is only the second time my wife has raised her voice to anyone in seven years, although I appreciate that has nothing to do with this case.
I have read the replies herein about such matters and if a Barangay settlement is not made I assume my wife needs to make a counter claim of oral defamation or unjust vexation. I am thinking it best to make a counter complaint of SIMPLE oral defamation, hoping that a future court will realize that this is a somewhat trivial case. Also if I am making a counter complaint when is the best time to do it? what do you think?
