slight physical injury

a pleasant evening to all..
gusto ko lang po sana humingi ng advice regarding sa kaso against us. I, together with my mom and 2 other minor sisters aged 16 & 17 ay kinasuhan ng SPI, oral defamation and threat ng kapitbahay namin. ito po ay nung nasa brangay pa lang.
ang nangyari po kasi, yung kapatid namin na 11 yrs old ay nglalaro sa kalsada ksama ung ibang mga bata. nagalit po yung kapitbahay namin at pinagmumura ung mga batang nglalaro. nakita at narinig nung isang kapatid ko na accused din, ung ginawa dun sa bata. ngkaron po cla ng exchange of heated arguments ng mother ko as well as my sisters. sa gitna po ng pagtatalo at pagmumurahan, akma pong isusubsob ng kapitbahay namin ung kapatid kong bata kaya dito po ay hinila ko siya sa buhok. nagpambuno kami sa kalsada.
pero sa report nya sa brangay, pinagtulungan daw namin xang apat, kasama pa nga po ung father namin sa written notice ng barangay. umattend naman po kami ng series of hearing sa lupon at humingi ng dispensa pero tinuloy nya pa din ung kaso.
ngkaron na po kami ng pghaharap sa prosecutors office, nkpgfile ng joint counter affidavit at reply affidavit sa tulong po ng lawyer na pinsan ng fiancee ko. nung lmbas po ang decision ng prosecutor, ito po ang nkalagay sa last two paragraphs: "accordingly, our names are hereby recommended to be charged with slight physical injury bail unnecessary unless required by the court"
"anent the complaints for Oral defamation and Threat both are hereby recommended dismissed as they were uttered during the attack itself when emotions are high and as such are deemed merely to be an extent of disgust"
na-arraign na po kami last mar.23. sa tingin po ba ninyo ay ano ang pwede naming kahinatnan sa kalagayang ito?

the complaint of threat and oral defamation was already dismissed by the prosecutor. Now the charge you are facing is the slight physical injury. if you can amicably settle the issue by way of compensating the complainant it would be best considering the cost you will incur in litigating the case. Now if you think that you can controvert all the allegations leveled against you and substantial evidence to prove the complainant wrong, then you should litigate and i suggest you engage the services of a lawyer to help you out in this case.

considering the case, should the complainant wins the case, you will also be advised by the court to pay for damages plus the jail term of arresto menor (1 to 30 days)

is there any chance po ba na mdismissed pa din ung SPI case against us. sun po kasi sa hearing namin sa fiscal, hipag nya ung gnwa nyang testigo saka ung isang kapitbahay namin, na umamin din dat same day ng hearing na he was just paid to testify?

in your statement that a witness was paid to testify would be your burden to prove it in court. now if the mauling really happened and the aggrieved party was able to document everything to prove her case against you, i am suggesting that you settle the matter amicably, this would be a win win situation for you. now if you can get a sworn statement under oath from the witness that he/she was paid just to testify against you then, you can use it as your defense.
bottom line you still have a long way to go in the litigation and will be incurring expenses. now on the practical side of it, your funds for the litigation if you can use it to settle the case amicably i guess it will favor you rather than fighting it out and end up losing the case plus compensating the complainant for damages that would be a double wammy on your part

evelyn pineda po..my ask lang po ako..1/27/2012 po may pumunta pong pulis sa bahay namin at may warrant of arrest po clang dala. nagtaka po ako at pati na din nany ko,dahil po wala po cyang natatanggap na sumon,warrant na agad..at ang kaso po is "slight physical injury" sa bata daw po..2010 pa po ang issue na un dahil may nakaaway si nanay ko at pinagbantaan po cya ng asawa ng kaaway nya kaya po lumapit po cya sa baranggay para ireport un,naifile na po sa baranggay at my date po cla para sa meeting pero di po cya sinipot ng taong un,at ito nga po my warrant ng dumating at sinisingil po kami sa pyansang 80thou pesos at hanggang monday na lang daw po un,dahil kong di daw makapagbigay ng halagang un,ililipat na cya sa provincial jail at ididetain.

ganong po ba kalaki ang dapat ipyansa sa slight physical injury?ilang araw po kung madidetain?hope masagot nyo po ang mga katanungan ko para po alam ko po ang gagawin ko.salamat.
