Hi po. I would like to ask legal advise in behalf of my cousin issue regarding resolution received sent from the fiscal office. This is regarding on the estafa filed against him. He already paid the full amount filed against him and instead to give counter affidavit he give affidavit of full payment. But the resolution stated that " affidavit of full payment has no proof of evidence". Recommendation to left the case in the trial court. But it was faithfully credited and transferred to the bank account of the complainant.What steps did my cousin will do.

Please give us legal advise regarding the resolution.

the alleged settlement should be done before the prosecutor hearing the case. If you can get a bank certification that you did deposited the amount in the account of the complainant it would serve your best interest when you can get to show it to the hearing officer. likewise you need to get a dismissal order of your case on the grounds that the case was settled amicably settled by both parties from the prosecutor.
