magandang hapon po sa lahat. gusto ko ho sanang malaman ang basic na trabaho ng isang fiscal pagdating ho sa paghawak niya ng isang kaso ng isang pribadong mamamayan.
ang isang fiscal ho ba ang umaaktong lawyer ng isang complainant? trabaho ho ba ng isang fiscal ang magsabi at magturo sa isang complainant kung ano ang dapat niyang gawin at dapat niyang ihanda na mga ibedensya? at tama ho ba sa isang fiscal ang magpahiwatig na wala ng pag asang maipanalo ang kaso dahil mahina ang ibedensya o walang ibendensya ang complainant sa gayong hindi alam ng complainant ang gagawin dahil hindi naman sila nagkakausap man lang ng fiscal bago dumating ang pagdinig?
sana po ay may makapagbigay ng tulong sa akin.

at the preliminary investigation level, the prosecutor is not your lawyer.

if it is at the court already, then he can be the complainant's lawyer. he may be expressing an honest opinion. best to coordinate with him as to how to prepare for the case.

thanks for the reply. yes he may be expressng an honest opinion but as we feel it, he is discouraging us to continue with the case, he did not even mentioned about the possibility that we can file a civil case as a reservation.. ang punto ko po sa pagtatanong ko e para magka idea ako kung kukuha na ho kami ng private lawyer. salamat ho ng marami sa comment ninyo,nabuksan din ho ang isip sa ibang bagay. salute!!
