I hope and pray someone can help me on these. I have already started paying down payment on a house and lot but later found out that the perspective drawing was not the real deal, the agent told me that for 2.4M I will not be getting a garage but if I pay a 100k more they will built it for me, I felt tricked on the deal for they showed me a perspective drawing with a garage so I have decided to withdraw my four months payments (200k+) for the down payment of 700k which I supposed to complete by Dec. 2011. My question is, can I have my money back? The agent said according to Maceda law I cannot get it. Can someone help me understand why? Pls. help.

under maceda law, no. but under civil code, if you can prove there was a substantial breach of contract, you can. the case has to be filed at the hlurb

keep negotiating. i recommend a compromise. it may be years before you get your money back in a case.
