help pls! estafa case?

good morning po, im rico of laguna heres my story po: bumili po ako ng kotse sa kakilalang ahente ng kotse dito samin worth 40,000php kia lang naman.. that was march 14 2011. sad to say after few days past di po parin niya mabigay sakin ung papers ng car may inaayos pa daw so nag taka nako kaya sinoli ko nalang yung kotse and tinanggap naman niya. then nag promise na ibabalik yung pera ko asap. lumipas ang araw, linggo buwan puro pangako he even offered na patungan ng interest ang pera kaya pumayag ako. basta patong lng siya ng patong ng interest. hanggang last may 1, 2011 nag agree kme na gumawa na ng promisory note then pinanotaryohan namin sa municipyo together with his id na babayaran nya ako ng umabot na sa 80k sa may 13 2011( siya po ang gumawa mismo ng promisory note again di po ako ang naglagay ng ineterest) sad to say di nanaman siya tumupad and ayaw na nya sagutin calls and texts ko. ano po ang laban ko dito and ano po ung mga steps na gagawin po. please please help me!!!! you can send a demand letter for payment. if you live in the same city, file a complaint at his bgy. then you can initiate a small claims case.

this is not estafa, just breach of contract.

can i force him to pay the full amount of 40k nevermind na yung nilagay nyang tubo para lang matapos na yung problema namin?

the way to force him is to file a small claims case or enter into a settlement with him.

sir halimbawa sabihin nya na babayaran nya ako lets say 1000 pesos a month kasi siguradong magdadahilan sya na di nya kaya magbayad. pwede ba akong tumanggi?? and if tumanggi ako at di kme nagkasundo sa bayaran what will be the next actio?? sir thaks sa replies!!! its a big help!!

anything is possible in a settlement. it is based on your negotiations and nothing will happen if it isn't both parties who agree.

you can still file an estafa case. i don't believe it will prosper but it may force him also to settle with you.
