I want to know if my daughter can claim financial support from his father who is working as a seaman. i want to know further what are the rights of my daughter as far as properties of her father is concerned.

the father was the one who processed her Certificate of Live Birth, that is why, at the back portion of my daughter's birth certificate, he signify his acknowledgement as the father of my daughter. therefore, making my daughter as his illegitimate but acknowledged daughter.

we were both married and have our own family already. but because the child is soon to enroll college, i want to demand bigger assistance because he is only giving one thousand pesos (1,000.00) every month.

but i cannot do it until the following questions are answered:
1. do i have the right to demand bigger financial assistance for my daughter?
2. up to how much my daughter should or will rightfully receive from her father's salary being an acknowledged daughter?
3. can i make the demand in behalf of my daughter?
4. does my daughter have the right to share from the properties her father have owned?
5. finally, until what age can my daughter claim help or assistance from her father?

i hope you help me with these confusing situation. thank you and more power.

respectfully,

Maria Estela V. Sarahina

1. only the court can decide base on the needs of the daughter and the financial standing of the father.
2 the court will decide
3. yes
4. yes, 1/2 of the legitime of a legitimate child
5. until emancipated

try sending a demand letter first. i'd still explore filing a criminal case of RA 9262 especially if you can show communication that he is refusing to provide additional support.

Good day!
How are you?
I just read the discussion you had with the subject above.
I am an illegitimate child (but with acknowledgement remarks on my NSO birth certificate) and my father went to US on Dec 2004 through Lola's petition.
Around November 2006, he stop supporting us and stopped communicating with us.
His parents used to hang up on us whenever we try to call them.
I went to my half-sister last year and gave me a false hope that they will help us and give us the new contact number of our father.
And just this morning when I rang them, was able to talk to her daughter from real wife, she told me that she does not want to give Papa's number to us and that Lola does not allow/want Papa to communicate with us anymore. I said I'm Papa's child as well but they stood their ground that they don't want to give Papa's number in US.
We don't know Papa's number and address in US.
I have younger siblings age 8, 15, and 22. Me and my sister did not get a 4-yr degree course and my mother does not have a stable job to support us.
I hope you can help us what to do..
Thank you.
