need help po. nakipag away po kasi kami ng mga kapatid ko sa babae ng asawa ko sa mall. Nagkaron po siya ng mga physical injuries. mag pa-file po daw sila ng kaso laban saamin. Ano po ba ang mga pwede nilang i-file laban saamin bukod sa physical injuries? If physical injuries po, ano po ba ang mga kaparusahan na makukuha namin sa ganung kaso? gaano katagal po ba kami pwedeng makulong at pwede po ba kaming mag piyansa? maari din po ba kaming mag file ng case laban sa kanya dahil pumatol sya sa asawa ko? maraming salamat po.

^Maliban sa Physical Injuries, maaari din kayo makasuhan nang Oral Defamation kung may mga nasabi kayong di kanais nais, at kung may kasamang pananakot maari din na Light Threat. Kung matutuloy ang case against sa inyo, maari naman kayo magpiyansa. sa parusang pagkakakulong, may mga pangyayari kasi na maari ninyong maging depensa na maaari magpababa nang penalty sa inyo. Kung gusto niyo kasuhan yun babae, dapat kasama yun asawa mo for criminal case na Concubinage, pero kung yun babae lang kakasuhan niyo, civil case lang ang pwede. Mas maigi, kung makasuhan kayo, magconsult agad kayo sa abogado personally, kung wala kayo pera, punta kayo sa Public Attorney's Office (PAO).

no, i doubt you'll end up in prison, but you may have to settle with her. if you pay bail, then the case can continue while you are free.

hes doing nothing. were haven't had a communication anymore.
but hes not with the girl also.

while it is not required, most prosecutors will require you to file a counter affidavit. i'm not too sure how willing the complainant is to have the reason why she was mauled come out, but who knows. nothing you can do but wait, or if you can stomach it, reach out and apologize and pay.

sulpena came now atty. they are now filling for a qualified theft.
whats there plan? we did'nt steal anything from her.

read the complaint carefully and then prepare your counter affidavit. see what facts they are alleging whether it fits qualified theft. it seems they are willing to make up a story just to get back at you.

may i ask if what is a qualified theft charges? is it much heavier case than physical injury? Thanks in advance

it depends on the value of the amount you allegedly stole. if more than P24,000, it is already non-bailable.

atty., they filed also same charges to my sisters but one of my sister is not there and they also filed against her. can we use that as a counter demand?

do not focus on a counter demand. focus on your counter affidavit first.

if your sister can conclusively prove that she was not there, then she can file a case of perjury, but that hardly ever prospers.

they also add frustrated murder and grave threat to us!
