ask ko lang po about dun sa government increase dito sa region 4a is 17php para sa minimum earners. above minimum earners po ba ay may matatanggap na wage distortion? kasi sabi po ng company nmin hindi namn daw pa sinabi na pwersahan na dapat ibigay ng company dahil ang sinasabi lang na bibigyan ay minimun earners lang. and isa pa po sabi po ng company nmin na pag kami daw po ay inappraise na (performance appraisal ) hindi na daw po kami kasali sa governmant increse kahit wage distortion ? tama po ba yun...

your remedy is to file a complaint at the NCMB of DOLE or at the NLRC. there are formulas for fixing wage distortion here: http://www.nwpc.dole.gov.ph/faq.html

atty. sinabi ko po yang website na yan sa company namin at ipinaliwanag ko po sa kanila na kahit above minimun earners kami dapat bigyan po kami as wage distortion. pero ang sabi po nila ay

"I believe that the mandated government increase pertains to adjustment of current minimum wage to a new minimum only, and does not obligate the company to give that increase (government mandated) on top of the company’s own compensation policy if the employee is already above the new minimum wage."

then sabi rin po ng atty ng company namin ay..


"Wage Order IVA-14 provides, "Upon the effectivity of this Wage Order, all minimum wage workers and employees in the private sector in Region IV-A shall receive a basic wage increase of seventeen pesos (P17.00) per day, across the area classifications."

at sabi po ng financing namin ay


"Those with appraisal are no longer included in this increase as their performance are regularly reviewed with merit increase while those under skill level only get an increase when there's distortion due to wage order."

Pero bakit hindi po nila binabanggit about wage distortion? Umiiwas po ba o nag papalusot lang sila?

kailangan ko rin po ba kumuha ng abogado para mag file sa NCMB at DOLE.

let us be clearer about this. you do not automatically have a right to an increase. it is only when the wage increase for minimum practically removes the distinction between the above-minimum and minimum workers. only then is there really wage distortion.

Wage Order IVA-14 has a provision on distortion.

Atty. Ex.. minimum earners is 320php. ako nmn ay 350php. then nag ka appraisla kami ng jan 1, 2011 which is now 378php. then jan 15, 2011 gvt increase.. minumun earners is now 337php. Question pasok pa po kayo ako sa wage distortion?

you should look up the implementing rules of the wage order. i cannot find one on line.

there is still a substantial difference between your salary and the minimum wage, so I am of the opinion that you are not automatically entitled to wage distortion. but it may be best to inquire at the nlrc or dole.
