hi, my company was recently acquired by another company. the new company did not pay the tenure employees any separation pay for our tenure in our previous company and now the employees has filed a case against the company. is it alright to resign even with a pending case? will that employee still get his/her separation pay from the filed complaint/case?

yes, because, the right to separation pay accrued.

note that in merger, the surviving company absorbs or the employees but the employer-employee relationship was never severed.

question, if a company gets acquired, are all current employees entitled for a separation pay? or are there any rules that require the new owner/company to pay the tenure employees for a separation pay?

moderator

it depends on the matter of acquisition. merger, purchase of shares - the company remains as a going concern and will just continue tenure.
