we bought our condominium unit 5 years ago and we are still paying it with HDMF formerly Pag-Ibig Fund.

Due to the earthquakes that was happening all over the world an inspection was conducted on our building and we found out that the structure of our building is not at par with the safety standards that the developer should have applied. there are cracks all over the structure and now all the occupants are being ask to vacate the building for repair and rehabilitation. we also found out that the structure of our building is just enough for a two storey but they built a 5 storey.

my question is can we sue the developer because now we have to find a temporary shelter while the building is under repair and because of greed they put a 5 storey building when it should be only 2 storey? and worse we will still have to pay for the monthly amortization to HDMF even if we're not living in our unit.

What shall we do? We need your advice badly. Thank you for your time and effort in reading my letter. Hope you can advice us on this matter. Thank you and God Bless.

yes, you can sue the developer, IF you can prove all these claims.

you can request it, but the hdmf is not obligated to agree.

Thanks atty. I'll just take my chances to request for a temporary stop-of-monthly amortization payment. God Bless. Hope you'll never get tired of giving free legal advice. Thank you very much.
