Yes legal pa din yan. since its the first 5 months mo.. pero sabi nga ni patok after 5 months binigyan ka ulit ng 5 months contract, yun ang illegal

salamat sir, pero may contract na kami dati na 6months at lagpas na kami dun pero iba na po yung name ng company namin pero same management lang po pwede po ba yun na magbibigay ulet ng contract tapos 5 months pa po.

bale sir nung una po pumirma napo kami ng contract which is 6months po ayun po yung unang name ng company. then ngayon po papapirmahan po ulet kami ng contract na 5months under new company name po dated po June 26, 2018 then ngayon lang po ibbigay yung contract at 5months pa po. bale ang plano po kasi ng manager namin eh kaya bibigyan kami ng 5months contract para di na kami irenew.

my advice is go to DOLE so they can inspect your company

yes just have dole inspect your employer and review the contract. Hindi illegal yung mag additional na 5 months contract. But dole may order your employer to stop the practice or treat you as regular employees. Marami kasing factors to consider. What type of job, ano ang nature ng business ng employer, project based ba yung employment etc.

Ang pinagbawal ay ang labor only contracting, yung ipinasok ang worker sa agency na hindi nag meet ng criteria to be considered a legitimate sub contractor
