Facts:
1. Legally married sila with a 7 year old daughter, sadly, the wife passed away last month due to cancer.
2. The husband has an affair, had 2 kids with the mistress (both 6 y.o. and 4 y.o. na ang mga kids nung nalaman ng wife last year) and nagsasama na sila ngayon.
3. Husband abandoned his then very sick wife last year. Throughout their marriage life, halos malayo sila sa isa't isa kasi yung husband pala, nasa mistress nakitira.
4. Nagdemanda yung wife last year. Long story short, na temporarily close ang case bec may agreement sila for the husband to provide monthly financial support.
5. The wife and daughter lived with the wife's father. After the wife's death, andun pa rin nakatira ang bata, with the guardianship of the wife's siblings and relatives.
6. Very insufficient ang financial support na binigay nung father sa bata. Kahit pa nung nagsama pa sila dati with the late wife, ang mga siblings ng wife na nasa abroad ang nag provide ng majority of the financial needs ng mag-ina.
7. One of the siblings sa wife, na married pero wala pang anak, wants to have full custody of the kid, considering they can provide what the child needs at very close din yung bata sa kanila.
8. Now, yung husband, is planning to file custody as the legal father.
QUESTIONS:
1. How can the wife's older sibling win the custodianship? Ano una nyang gawin?
2. Ang decision ba ng bata ang magiging basis for custodianship?
3. Gaano katagal matatapos ang mga ganitong kaso?
4. For the wife's siblings, ano pwede nila ikaso against sa papa nung bata?
