Good day atty,

Just to give you background, My mother just passed away and my father used to have mistress since my mother was still alive, they had 3 minor children. Now that my mom retired can we the legitimate children file for a case for the mistress or to my father? can we also change our last name? we are really having a hard time what to do, we've been experiencing moral damage since my mom left us...

what case do you want to file against the mistress of your father?

what moral damage have you been experiencing since your mother died?

atty. the properties they have together is a farmland and a joint savings account.
Moral damage in such away that they dont give as shame, our father would like to give his last name to his illegitimate children and marry his mistress.
What case can we file against them? are we entitled to file cases?

i'm afraid your half brothers and sisters have the right to bear your father's name and now that your father has died, he can marry his mistress.

you can file a case for damages against the woman under art. 26 of the civil code.

argue that you are now co-owners of the house. try to collate your family's properties and have your mother's estate settled.
