Notice of Cessation of Business

Sana po matulungan ninyo kami sa situation namen ngaun,We were former employees of a company owned by foreigners and just recently pinadalhan po kmi ng letter from the atty about Notice of Cessation of Business.3 weeks npo ang nkakaraan and wla pa po kming blita sa separation pay or backpay nmen..Are they reliable for backpays or separation pay pag gnun po ang reason ng comapany?Please advice.

when the company is shutting down, you are supposed to be given notice 30 days in advance and be paid for that period, plus separation pay. i recommend you inquire with the lawyer. good luck.

the letter says the effectivity is on april 1,2011.So pano po pag lumagpas na ng april and wala pa rin po kming pay..Ang sabi po ng VP namen this is handled by a law firm and he gave us contact info about the law firm pro hindi po ngrereply ung atty..Ano pong maadvice nio smen kpag past april wla pa?

Our company is experiencing serious business losses. After
reasonable efforts to abate this worst scenario, we have come to a
conclusion that there is no other option for the company except to cease its
business operations. For this reason, we inform you that we will cease
operations on 01 April 2011.

In compliance with the notice requirement under Article 283 of the
Labor Code, please take notice that as a consequence of the cessation of
business operations, your employment with us will be severed effective 01
April 2011.

Finally, we have also properly informed the Department of Labor and
Employment about this matter.


Is this a valid letter sir?they havent discussed anything about separation pays and backpays..

yes that is valid if it was given to you 30 days before effectivity date.

if they do not pay, then your recourse will be to file a complaint at nlrc.

Atty,Its been a week now and april 1 is about to come.Still we dont hear anything from them and no news with the attorneys that they said handling this concern.We are all afraid this might end up to nothing and still we are clueless,Were all thinkin that what if they are already out of the country and what shall we do if its already past april 1 and still no results?Please Advice..Thank you in advance..

contact the lawyer. your recourse is to file a complaint at the nlrc. you can also file a request for a watchlist order.

Atty.Nagdeclare na po sila ng bancrupcy ang hindi kmi nababayaran..wala na po ba kaming magagawa tungkol dun?

you will have to file your claim at the court where they filed bankruptcy.
