Hi. Need some advice lang po. I’m working in a hmo company as sales manager without basic salary. Commission base Lang po. Meron ako isang tao na may cash advance sakin na 10,400. Meron po sya receivable na commision amounting 11k+ so hindi nmn ako nag worry na hindi nya ako mabayaran. But he decided na umalis ng company. May rule po kasi ang agency namin na kapag umalis ka ng company di mo makukuha ang pending commission mo. Nakiusap po ako dun sa tao na baka pwede na hintayin muna nya makuha yung commission nya bago umalis pero it ended up na di nya ko pinagbigyan at umalis padin sya. Gumawa po ako ng request letter sa pinaka head namin na kung pede makuha ko ung cash advance at ibawas sa pending commission nung umalis kong tao pero syempre rule sa agency nmin na mahohold tlga ang commission pag umalis ka. Di padin ako tumigil s pakiusap ko sa head nmin hanggang sa pinagbigyan nya ako pero 6,400 lang po ung binigay sken. Gusto ko po sana makuha ung natitirang 4,000 so ive decided na singilin ung mismong tao na cash advance sken pero nagmamatigas po sya. Sya ung matapang. Ano kaya ung legal action n pede ko gawin? Can I file a case of estafa? Pls help me. Gusto ko po sya bigyan ng leksyon. Thank you in advance.

You can file a collection case in a small claims court. Expedited yung procedure dito, so it won't cost you that much to file the case. It is even possible to do it without a lawyer, but you have to check the courts and see the procedure for yourself first before taking my word for it.

At any rate, you can also ask the advice of a lawyer as to how small claims collection cases go about.

I apologize, but I am still a law student and I can't really recommend a lawyer to handle your case. I am not qualified to do so, yet.

A case for a collection of sum of money is the proper case to file in a small claims court.

If you can secure a certificate of indigency at your local barangay hall (to certify your financial incapability), the Public Attorney's Office (PAO) can give you free legal advice.
