Child support

If we can ask, is there a specific percentage or amount should the child receives from the father? The father earns 18500 basic monthly salary plus 2000 rice allowance per month, salary is being paid in biweekly basis. More or less the gross monthly income is 10,000 per pay out (before deductions), so the father provides financial support to his illegitimate children consistently 3, 000 per pay out (biweekly). The father lives with parents and 2 younger siblings and he is the main source of income. However, the mother of the children claimed that the 3, 000 per pay out is not enough for their 2 illegitimate children. She demands 5, 000 per pay out which the father is not capable of since he has bills to pay and needs to support his old parents as well.

There is no cut and dry percentage of income that the law says should be devoted to support. It is always dependent on the capacity of the one giving and the needs of the children.

Im a single mom, pa advice naman po kasi ung ama ng anak ko hindi po maayos magsustento.nagbibigay lang po sya ng goods, minsan isang pack na 900mg na bearbrand o kaya maliit na bearbrand tapus 12pcs diaper.minsan wala, minsan 20php pambili almusal,pinabayaan konlang kasi ayoko ng gulo pero ngaun meron na syang matinong work at nasa abroad na e baka naman pwede na syang magbigay ng maayos na sustento,nagmsg po ako sa kanya tru fb. Unfortunately blinock ako at ung account ng parents ko. Nakakausap ko naman po parents nia kasu di ko lang alam kung sino nagblock sya ba o ung babae nia.. Gusto ko lang ng maayos na usapan about da sustento pero sa nangyari e mukhang ayaw makicooperate ..pwede po ba akong magsampa ng kaso against him kahit same kami nasa abroad? Taiwan?sustento lang po ng anak ko hinihingi ko di ko naman po gustong guluhin ung pamilya nia na sumira sa pamilya namin 🙁

Hi. Just to share with you my experience. You need to write a demand letter through a lawyer or pwede ding ikaw muna, then pag walang sagot through a lawyer. This will serve as your documentation that you made a demand. Kailangan kasi you make a demand. If he still does not respond, then you file a case. Kung me trabaho sya and he still refuses to provide support, economic abuse yun.

katcha, just make sure he continues to give support and you retain proof of remittance. That way you have a defense if the mother tries to file a criminal case.

yourmom, go to the PAO in your area and ask for assistance in filing a case for RA 9262. Hopefully the father signed the birth certificate
