Hi po.. Ask ko lang po sana if possible po ba na ma refund pa namen yung pera na naihulog namen sa bria homes kasi po hindi na po namen itutuloy yung unit na kinuha namen doon.. Nakalagay lang po kasi sa paper na pinirmahan namen nung time na nag avail kami ng unit reservation fee lng ang non refundable.. almost 1 year na po kasi kaming nag babayad sa bria homes then binisita namen yung site till now wla pang unit na nkatayo as in puro damo lang ang nandoon kaya nag decide kami na wag na lng ituloy.. nkalagay din po kasi doon sa pinirmahan namen na 4-6 months lng daw ang construction ng unit hanggng ngyon wla nman unit na nkatayo doon..

Review your whole contract first and see if there are any terms and conditions regarding refunding all that is paid for the construction of the house, since you have signed said contract and agreed to its terms.

If the period stipulated is indeed 4-6 months and nothing has been built yet, then it is considered a breach of contract and you can file a case against them for such, plus damages. You can ask for a refund then as part of your petition that is being prayed for in court.

But before engaging them in litigation, try to talk to a representative of Bria Homes and ask them to have the amount refunded. Maybe it can still be done without any need for any court processes.
