few days ago we got involved into a car accident... our car's registration has been expired and the other party the single motor driver has no driver's license, not wearing helmet, and no tail light (back light). They suffered bone fractures along with the company of the motor driver (angkas). We are all in fault but they required money from us for their hospital bills, food and etc. (more than 100 thousand na nakuha nla)... the thing is, the police inspector did not investigate legally and did not investigate both parties (gumawa pa ng sariling statement ang police na hindi naman nasabi ng aming driver)... they have been conniving for us to to shoulder all the costs of the accident.
my question is...
1. if we proceed to the court instead, is there a chance we could win?
2. Alin sa dalawa ang mas may kasalanan... driving without license or driving unregistered vehicle?
3. Pwede ba naming kasuhan ung mga police officers on duty for not even doing the basics which is to check the driver's license of both drivers involved in the accident? and tampered our driver's statement without interviewing... at sila pa ang naguudyok sa other party na mag demand ng magdemand sa amin. financially.
4. what legal grounds can we use against them?
