Pasensya na mahaba. Hello, i need some legal advise. One of my relative was accused of having a teacher-student relationship. A talk was set on principal's office and all agreed that my relative will be distant to the student. What was talked about at the principal office was that the student felt attached to the student and that my relative does not feel the same. But since they are on the same school it is not uncommon to be not seen near each other especially my relative likes to help students, yes she is very helpful to ALL students and co-teachers as well. The case went out of school and the cousin of the student filed a complaint in brgy entitled "pakikipagrelasyon sa studyante". Before they file, the go in facebook account of the student and pretend they were the student to get into the group chat of the whole class. They threatend the whole class that they won't be going to graduate if they dont talk, (those who dont have any idea about the matters is now knowledgeable in the issue and because of that all the time my relative and the student was seen in the past now have malice). The cousines screenshots the fb conversation to some parts that would favor as evidence that they have relationship like saw them together on some instances and that's it. Also, before going to the principal office my relative was summoned by the cousin because the student left home, she as a teacher and dont want to further worsen the case went to pick up the student and return her home. They video recorded the conversation without my relative knowing it, she just knows it when they begin to threaten her to have her license remove and be kick out in the school. but nothing is substance in the video the cut out the part that will then be against my relative. And then they started to make up stories that my relative plead guilty of the relationship but nothing like that happened. She just explained her side. Beside she cant reject the students feeling straighforward as she is a teacher and that is not good for the student. But she is really close to the student. My question is, is selected screenshots of conversations and the video enough to have her licensed remove? Also, since her reputation was wounded what case she could file against the cousins? Can she file slander, defamation,libel because the cousins explicitly told a class of student regarding the allegation? What case can be filef against threat? My relative is depressive in nature and tried to commit suicide because of the incident, can she filed unjust vexation? Harrasment?
What are her right? Can she have some letter stating that if they continue harass her she will file a case against the cousins? Is she in a win win situation?

Since the situation is complicated, I would advise her to hire a lawyer to protect her rights.

Regarding the teacher's license, the issue must be escalated to the CHED if the school's investigation yields negative results. But the remedies in the school must be exhausted first before escalating the said case.

The issue with the recorded videos and reputation-smearing must be assessed by a lawyer so that he/she can gauge if there is a case to be had with the evidences on hand. Sadly, we can only do so much here in a forum setup.

Alternatively, please go to the PAO or any free legal aid clinic (IBP chapters and Law Universities usually have one) to get free legal advice regarding your situation.
