My Ex-Husband sold our building without my consent while I was living in US. Please Help!

Hello,

I am currently in the Philippines right now. I just found out that my ex-husband sold our Building to a relative without my consent. I found out through a family friend. I am very disappointed because this Building was suppose to be for our 2 kids we have together. The land title of the building is not under our name, It's under my ex-husband's father and his brothers and sister. They allowed us to build a building on their lot. I have remarried again in the states but I have not yet filled an annulment in the Philippines. So, the property we have together should have mine and his signature before he can give out a deed of sale. I am not sure yet how he was able to do this with my knowledge and consent. I have a feeling that my signature was forge. I need some advice what I can do before I confront my ex-husband. Any advice will help as I am trying to get more facts sorted out.

first find out if the title was transferred, and if so, get a copy of the deed that was used to transfer it. these are all available at the Register of Deeds.

are you no longer a Filipino citizen? did you get a divorce?

@attyLLL Thanks, I will check if the title was transferred and get a copy of the deed of sale. Do I have to go to the city where the property was sold for a copy if it was transferred?

I hold a Canadian Citizenship but I am currently living as a permanent resident in the US. I no longer have citizenship anymore in the Philippines but I was born there. I've not yet filed for divorced/Annulment in Philippines Court but I have filed for a divorce in US so I can marry my husband now.

@attyLLL The land title is under my ex-husband's Family(Father's Side). They allowed us to build on their property because they wanted us to live there. So, that means my ex-husband could only sell the building that we both own to my relative. The building permit is under both of our names. He could not sell the land because it neither one of our names. I am just planning to speak to him and find a solution to this. I know he will be very angry if he knows that I found out about this. It was a very sneaky move from his side to do this to us. Our kids are very angry as well and my son would like to speak to him. This is a very complex situation but I need to get this resolved before I go back to the states in a couple of weeks.

which came first, your becoming a canadian citizen or the filing (not granting) for divorce?

Let us back up, I see you changed property to building. This makes a difference. Go check if there was any transfer in the tax declaration or the title. My guess is that there may have been none.

@attyLLL - Becoming a Canadian Citizen came first before I filed for divorce. No, there was no transfer in the tax declaration or title at time being.
