Hi All, I would like to seek an advise regarding sa ginawa po ng companya sa amin,

We are enjoying two kinds of salary, last year I just joined last year
We have basic and confidential salary

So overall meron po kaming lahat nakukuha na basic na 15k
and sa confidential salary lang kami nagkakaiba-iba depende sa pinirmhan namin na net agreement, now ganto po nangyari nagkaroon ng adjustment dahil sa TRAIN law imbis po na tumaas salary namin or takehome bumababa po, with regards sa expected namin takehome pay. or agreed net pay with our employer, sa akin po almost 1 to 3k per cut-off nawala per cut-off. inconsistent po talaga and paiba-iba nangyari dati sa Accounting kami nanghihingi ng payslip ngayon po HR manager na nagbibigay.

Are both salary taxable? bakit may confidential pang salary? san nawawala yung 1-3k per cut-off mo sa basic na 15k or sa confidential. Paki linaw ng maigi para mabigyan ka ng tamang payo.

Hello po ang ginawa po nila si Nagmerge na daw po yung Basic namin at confidential salary, mostly po sa amin kasi Confidential ang malaki since wala pong tax iyon, palagay na pong 5k per cutoff, nakukuha po namin sya ng buo ang nangyari po nung pinagsama nila, ni wala pong advise sa amin na mangyayari iyon kahit email wala, lahat kami nagulat na lang. Noong January 15 ang nangyari po wala talagang tax since di pa daw nila naadjust next pay po bigla na lang nagtax ng malaki para daw po macover yung tax. yes po di nakadeclare sa BIR

Ate check mo po... una po yearly po ang computation ng tax natin since nasa company po tayo. add mo po yung salary mo saka yung overtime if lumagpas na po ng 250k for the whole year yung lampas na doon taxable na po yun so dun tayo sa confidential. yung bonus po natin kasama po 13th month if lalagpas ng 90k taxable na po yun.. syempre ibabawas nyo pa po yung kaltas sa mga benefits natin. Sa bago pong train law di na po tinitingnan kung gaano po kadami ang anak natin.. Kailangan maipaliwanag sa inyo ng HR kung paano ang TRAIN law inaaplay sa sahod nyo.. mas maigi pa na ikalat na nila yung kaltas sa tax sa simula pa lang kaysa biglain ka sa dulo.. mas madami ka OT talagang aabutin nyo po ang 250k..

Mali yung title mo. Di kayo nagkaroon ng salary deduction or lumaki ang tax deduction dahil sa train law. this is misleading.

Nagkaroon ka ng salary deduction or tax deduction dahil nag merge ang 2 payroll ninyo, the confidential or non-taxable and the taxable, kaya lumaki ang baseline ng computation ng tax.

Kasi, IMO, there is no diminution of salary and benefit, there is no illegal deduction.

If you have a problem with the merging of your payroll, go talk to your management. di kayo na inform? talk to your management. its a problem with communication and this can be solved with communicating with your management.

Ganon naman po talaga, taxable po lahat nang income, so yung confidential na sinasabi mo eh dati parang non-taxable allowance.. so sinama na sa basic nyo, so lumaki na ang basic salary mo, pero taxable na po lahat. Wala pong nalabag na batas.

Kahit pa yung entire amount ng pinagsamang basic and confidential salary mo ay taxable, hindi ko parin maintindihan kung paano bumaba ang take home pay mo because of TRAIN (maliban na lang kung sumusuweldo ka ng mahigit 8 million sa isang taon). Designed kasi ang TRAIN law para tumaas ang take home pay ng karamihan sa mga salaried employees.
