Hi. Sana po may sumagot. Nag loan po ako sa tao ng 300k 2 yrs ago, ang agreed interest ay 5% at mron po akong pinirmahan na mortgage at deed of sale pero hnd nya pina notarize. Nakabayad na po ako ng 150k pero dahil tumakbo na ng dalawang taon, gusto nya n byaran k pa ang 360k na interest. Hnd ko po to kayang bayaran. Pinakiusapn ko po n ibaba ang interes pro ayw tlgang pumayag. Ang value ng property ay nasa 4million. Ano po kya ang pwedeng remedy?

The legal remedy is to file a complaint in court and allege that the agreement is void because of the unconscionable rate of interest. however, if the title is with the lender, they might try to have that auctioned through an extrajudicial foreclosure depending on the terms of your agreement, but you can also argue that there is falsification because you were not present during the notarization (he has to do that if he wants to enforce it)

Greetings po mga Sir and Madam
Binili po ng parents ko ung lupa kung san nakatayo ang bahay namin 10 yrs ago. Pero inde pa po fully paid at verbal lang. First cousin ng lolo ko ung may ari. Pero kami na po nagbabayad ng amilyar. Pero namatay na po ang mga lolo namin and then recently ng nag update kami regarding status ng lupa, ayaw na i honor ng mga anak ng may ari kasi wala naman daw kasulatan. Ano po ba ang puede namin gawin?
