my grandfather and grandmother have their own property, .. They have been left Six children, They decided to sell all the property and all they signed except my uncle who objected to signing an Extra judicial settlement stated in the extra judicial settlement that they are both heirs and sellers while I am the Buyer .... they did not sign their youngest child for the reason that they did not want to sell the part .... my question I have a buyer now with this property, Can I buy the five parts I bought when they were not signed by one of their siblings? ... pls help po..tnx

yes, that can be done. A sale by 5 out of the 6 co-owners is a valid sale. the buyer and the remaining 1/6 owner will become co-owners of the entire property. However, it will be difficult to register the sale and have a new title if the 1/6 owner does not sign the EJS even if his share won't be sold

kumbaga po magpapanibagong sukat na naman at rehistro yung lupa between buyer at seller kapag ayaw talagang pumayag na pumirma?willing naman po pumirma kaya lng masyadong malaki yung hinihingi nya para sa parte ng lupa nya..
