Hi. I would like to seek for an advise. I don't know if you are familiar with "SANGLA KOLEKTA". We're new in this kind of business. We decided to invest because the interest is better rather than investing in stocks. We have an agent, our agent is the one looking for client who will borrow money and in return they will mortgage their property (ex: condo, apartment or house) and they will give us the copy of the land title. Usually the contract is 3mos to 1yr. The interest should be paid through POST DATED Check. We have one client who was delayed in paying her monthly interest. By the way, the interest was offered by the borrower and agent. She told us not to deposit the check, and she will pay us in full at the end of contract. Here comes the end of contract, she told to extend the contract for 2mos because the money that she's expecting is not yet credited in her acct. Fastforward, we ask for a legal assistance with PAO because the borrower told us that she left the country for a business trip. The atty told us to go in their house to talk to that person, even to her husband and other family members. We knew that her husband was not knowledgeable of what her wife is doing. We file a complain in Barangay. We already have the CFA. Upon further investigation, we found out that the title she gave us was not authentic. The property is not hers'. Also she didn't go out of the country. And the check she issued to us bounced due to closed account. IF we file the case to court, what is the chances that we can recover the money? and what are the case that we can file? Thanks!
