Good Day po Atty:

Newbie lang po ako sa forum nato. Natutuwa po ako at may ganitong klaseng site at malaki ang maitutulong at matututunan nito sa amin.

Gusto ko po malaman atty kung kasama po ba kami sa rent control law. kami po ay 3 yrs na nang-ngupahan sa isang apartment na may rental fee na 5000 pesos monthly. dito sa Cabanatuan City.

sa pag kakaintindi ko po sa rent control law o R.A. 9341. kung kami po ay tataasan ng montly rental ay hindi po ito dapat lalagpas sa 7%, tama po ba? sa makatuwid 7% of 5000 (rental fee) is 350.

kung sakali po na gawin 5500 pesos ang gawin samin increase rent at hindi po kami pumayag dahil ayon sa batas ay hindi dapat lumagpas ng 7% increase. At kami po ay pinaalis sa apartment.

Saan po kami pwede magreklamo? at anu po ang pwedeng matibay na ebidensiya ang pwede namin panghawakan?

Umaasa po ako na matutugunan nyo ang aking liham. Salamat po...

it is actually ra 9653 which is in effect now.

if 5,500 is demanded, then you can lawfully refuse. you can keep possession of the apartment and you should keep paying the rent at 5,350.
