LAST PAY - MY COMPANY DEDUCTED MY LAST PAY FOR UNSETTLED CHARGES OF THE GUEST

I’m a former Guest Service Assistant in one of the hotel in Davao City and I’m a casual employee for over 2 years and 10 months then I’m being endorsed as regular employee in the company for over 2 years.

              Last April 22, 2017, I have my vacation leave for the preparation of my pregnancy delivery and last April 24, I delivered my son through a caesarean section. The hotel already informed about my situation and I have a 78 days maternity leave according to the law. During my leave, I and my husband are discussing about our work and about our baby. After a month, I decided that I will stop working and nursed my little one and I informed my supervisor about my decision. Last June 16, I personally message my supervisor asking about what date I should put in my resignation letter. I asked her if I can put July 16, 2017 since I still have a vacation leave left and my maternity leave will end on July 10 but she replied that as per Front Office Manager I should give my resignation letter as soon as possible. Since my supervisor was off duty that time she called the hotel talking to our manager regarding to my resignation date then, she message me that as per there conversation our manager advised her to tell me that I should put June 30 as my resignation date and this is also the advised by HR Manager and since I will not be able to come back to work so that they can looked for a new replacement for my position. I asked her how about my remaining days of maternity leave since it will end until July 10; she told me that as per our manager he HR will pay the remaining days of my maternity leave. Since that’s their decision and I agreed about it, I immediately forward my resignation letter thru e-mail since I’m already living in Pikit, North Cotabato and our manager need it as soon as possible.

After I gave my resignation, I went to the hotel to get a clearance form and processed it as soon as possible. I went personally to each department to let them signed my clearance. The last department I went was the Finance Department, I personally see the Finance Manager for my clearance but before she sign my form she went to the Chief Accountant to check my account after that she signed my clearance form. So, all departments cleared my form without any hesitation.

After a month I processed my clearance form, my husband asked me if I already got my last payment and I told him not yet. I asked some of my former colleagues regarding how long they get there last pay they told me that they got it after 3-4 months from there resignation. Since I already lived in Pikit, North Cotabato, I just texted the HR asking for my last payment but they replied that they will check it and they will gave me a feedback. For almost 5 months of following up them they always gave me NO FEEDBACK. Then last November, I texted them again and now they gave a feedback informing me that I don’t have any last payment will received because according to the finance, they already deducted some of the unpaid bill of hotel guest accounts and my last payment was still not enough to pay those unsettled accounts of the guest. I was shocked because in the first place, they didn’t inform me when I was processing my clearance and I personally went to the Finance and they signed it without any question. They didn’t even show me what are those deductions was and I know that this is against to the labor.

my question is ... tama po bang ideduct nila sa akin yung mga unsettled charges sa akin? without informing me and I didnt sign any papers indicating na pwede nila ideduct sa last pay ko un lahat. at is there a law about this???

Hello po Good Day, ask ko lang po kase po na endo po ko last April 24,2017 gang ngayon po wala padin yung backpay ko yung iba ko pong kasabayan nakuha na nila yung kanila pero yung akin wala pdin po, naka pag clearance na po ko and it's all clear, pero c bank po yung nag ka problema i'm asking and calling my HR pero lagi po nia sinasabi na uupdate nia na lang aq kase di rin daw po nia alam bat nag ka gnun pero wala po update, tapos bigla under investigation. napaka tagal na po kase eh anu po kaya dapat ko gawin? marami pong salamat

Check your policy.

I previously worked in a hotel industry and all front desk personnel are responsible for "getting" the payment from the guest (payments such as room charges, food, etc).

Granted nakapag clearance ka, and in the first routing of clearance, any unsettled charges was not seen, na clear ka, but during the course of computation, it was found out that there were unsettled charges, then you are still liable for that. hahabulin ka nila, but in this case, they can deduct it from your final pay. now if you have a question about those charges, why not contact the HR and ask what charges are those.
