Good afternoon, nag resign po ako sa previous employer ko ng Oct,2012 and ng mag follow up po ako ng final pay ko nung December,2012 hindi pa daw available, which I think dapat meron na kasi 13th month pay should be given before Dec.24. Pero inintindi ko nlang muna po. My final pay consist of my half month salary and 13th month pay for 10.5months. Nang i-follow up ko ulit this Feb.15,2013 they told me na binawas ang SSS loan ko na 37,000+, which i applied sa SSS in 2006 and not within my employment service sa kanila. I worked from them starting 2009. Hindi ko dineclare and loan to them because I'm thinking of applying for condonation at ako nalang ang mag sesettle sa SSS kasi nga hindi naman sila involved ng mag apply ako ng loan. Pero nalaman nila n may loan ako kasi nag advise ang SSS sa kanila pero that time I'm not employed anymore to them. ang sabi nila kasi ayaw sila issuehan ng SSS ng certification kasi may mga deliquent employee daw po sila which is kasama ako. Tama po ba ang ginawa nila kahit wala akong written consent sa kanila at hindi naman nila practice gawin yun ng nandun pa ako sa kanila? May mahahabol pa po ba ako at can i file a complaint sa NLRC for this? Thank you po in advance for your answer to my queries.

the company could be correct as you were still their employee and they can not get clearance since you have outstanding loan sa SSS..

Ang practice po sa opisina namin, once na resigned na ang empleyado we automically reporting it to SSS that they are no longer connected with the company. By that, we will not be liable with their loans. The letter should be notarized and received by SSS. We're also asking for the Master List fromt SSS so we could check if they have removed the inactive or resigned employees on the list.
And In my opinion, loans can be carry over to the succeeding employer. So regardless if they are not involved with your loans they are still affected kase naging employee ka din nila. at carried over from previous employer.
