I have a question po regarding on my Last Pay. I was on maternity leave last February and was receiving a pay on my payroll. All I thought my employer was generous because they included me in the payroll and at the same time release the 1/2 amount of my SSS maternity benefit before I took my leave.
After 21/2 months I got back from Maternity Leave, my payroll was continuous as normal. No one notify or informed me that I should not paid in payroll during my Maternity leave until such I filed my resignation.
When I resigned in the company, I was cleared as my clearance was signed off by HR, finance and other departments. When I send a follow up for my final pay check, the HR informed me that there was an over payment on my payroll due to maternity as I was paid on payroll for that time. They only knew that I was overpaid when they calculate my final pay. They will offset the over payment on my last pay (13th month/hold salary/leave conversion/tax refund) and in return I'll be the one paying my Employer due to negative amount/offsetting.
Just want to seek an advice if do they have the right to offset the over payment on my last pay. They just knew because I resigned and suddenly they would immediately offset it on my last pay and the HR still wants me to pay the remaining excess because my final pay is not enough to cover the said overpyament.
