Hi, Attys!

Would appreciate your quick help on this.
Im an account specialist. Basically, sales officer offering creative/branding services to big clients like Robinsons Land. I resigned last June 2017 due to stress and health condition since I had dengue last March (plus micro managing boss adds to the mix).

My resignation letter stated that I am willing to render 30 days for smooth transition. To my surprise, my aggravated boss shortened it to just 5 days. His ego was shaken so he wanted to have the last say. I had on going projs that time and pinaspasan ko to complete my pending tasks until the last day, June 21. My turnover docs has been received and acknowledged by Mr.Boss. The usual release of backpay is after 3 mos, and so I waited.

After a month of resigning (Jul 21), the Finance manager said that I will not be cleared bec there is unpaid bill of Robinsons Land in 2016 which amounts to 180k. Nagulat ako kc akala ko ok na dahil wala naman silang immediate concern ng matapos ko turnover. They asked me for proof and I gave the viber/text messages/email exchange of client that they approved/allowed this charge (btw, all of these were included in the turnover docs that I submitted before my last day. Inulit ko lang isubmit para wala ng problema).

After that, client gave their approval verbally last Sept 30 and asked for additional proofs that the design of billboard was done completely
(like jpeg/psd files and receipts of printing the material)

Now, the finance is firm and said that they will clear me and process my last pay ONLY AFTER the client has signed the papers together with attached proofs/receipts. Hindi daw pwede ang verbal lang.

Christmas is in the corner and client has still not signed and I only get incomplete updates from HR. 3 pa naman ang pinapaaral ko tapos Pasko na. Matagal na din ako naghintay.

My questions:
1. Is this legal? I have turned over everything, waited, resent turnover docs and eventually, client approved verbally.

2. Makatarungan pa ba ihold ito at dapat ko pa ba talaga hintayin na mapirmahan? Nde ba dapat kargo na nila yun maningil lalo na't wala naman ako ninakaw at wala nako sa kumpanya?

3. Malaki ba ang laban ko sa NLRC o DOLE kapag nagcomplain po ako?

4. Ok lang ba magcomplain ng money claims sa NLRC/DOLE kahit na hindi ka pa cleared kung ito naman yun mismong dahilan kung bakit nadedelay ang lastpay ko?

Ngumingiti ang boss ko panigurado dahil sa kakahold nya, nagbubunyi sya na sa ganitong paraan, napapahirapan nya ko. Bakit may mga ganitong tao. I just want to get what is due to me and to my family.

- Do you have proof of what was turned over - usually a list of what documents and whats not.

- yes the employer is responsible in getting the payment from the client.

3. Malaki ba ang laban ko sa NLRC o DOLE kapag nagcomplain po ako?

- yes

4. Ok lang ba magcomplain ng money claims sa NLRC/DOLE kahit na hindi ka pa cleared kung ito naman yun mismong dahilan kung bakit nadedelay ang lastpay ko?

- depends on the clearance you are talking about. If they claimed that you have not collected the money from the client, DOLE will rule in your favor since it is no longer your job because you are no longer their employee.

1. Yes, there is an enumeration of tasks completed and essential info for ongoing projects where I remarked the next steps for quick follow through. Included din yung proofs/approval of client for this specific concern ng Robinsons Land.

Actually, kung ano yung sinend kong docs nung last week ko, yun din ang pinakita ko sa kanila. At yun din ang nakapagpaapprove verbally sa client. Nagsayang lang ng oras kc paulit ulit.

2. Para kc nila ako inuutakan na since ako daw yung account handler, dapat ako yung maningil or nasingil na ang client 2016 palang. Pero may projects talaga na delayed ang bayad at itong 2017 palang nasisingil lalo na at natapos un proj ng Dec 2016. Ang mahalaga e may proof ako na approved ng client.

Nagpadala ako sa client ng billing thru email and hardcopies Feb 28 this year pero hindi pinansin/pinirmahan. Naoverlook, kaya pala nde pa din bayad.

4. Based sa HR, yun lang daw ang dahilan kung bakit hindi pako cleared. Sa kumpanya namin, HR ang nagpapakalat sa concerned departments at nagffurnish ng clearance. Noong Sept, sinabihan pa nila ako na pag di nagbayad ang client, posibleng ideduct sakin ang 180K. Kaya mula sept, halos araw2 nako nagff-up bec I think may mali na sa ginagawa nila.

Additional question:
5. Pwede ko ba makuha komisyon ko? Malaki napasok kong sales this year (mga 15million, kota na nga ako at top performer ng magresign) pero wala ako nakuha dahil once collected lang, saka lang bnibigay ang commission.

Kc parang di pa tapos yung employee-employer relationship namin kung hinold nila ako ng 5 mos. So dapat yun mga paid projects at collected na mula Jun to Nov, makuha ko pa?

I thought you're going to NLRC so that's why there is no need for me to reply.. anyway for #5 include it in your monetary claims, though I doubt you can claim that.
