Hi there,

Good day! Need legal advice on my birth certificate concerns. I was already 14 years old when my mom filed a late registration together with my sibling birth cert. My mom use her last name and not my dad's because they were not married yet during that time. The problem is I've been using my dad's last name in school and all other documents. As they got married we forgot to correct our birth cert to my dad's last name until such time my dad died and he cannot attest already on our petition to change our last name. All my government ID (SSS, driver's license, voter's ID and the like) and marriage contract are all under my dad's last name but my birth cert is not. What should I do? I cannot get a passport because of this dilemma. Please help me how to correct.

Then the issue would be establishing filiation between you and your dead father. You can either have your father's remains exhumed for DNA testing to prove filiation or have all your documents using your father's surname corrected.
