Ask ko lang po, ano po kayang pwede kung gawin?kasi nagresign na ako sa dati kong company tapos ngayon po hinahanapan ako ng open case sa BIR ng HR namin doon, tama po ba na ibawas nila sa last pay ko yong penalty sa BIR, if meron ngang penalty noong time na ako yong may hawak sa filing ng BIR ng company? thank you in advance.

Napatunayan ba ni company na ikaw ang liable for those penalties?

hindi pa naman, pero kung mapatunayan ba?may karapatan ba sila na e magdeduct?saka what if may proof naman na nakapagfile naman ako sa BIR?

if proven na at may judgement, then yes then can do that unless you want to pay out of pocket. if may proper investigation naman na nangyari at napatunayan talaga na ikaw yung liable, even if escalate mo sya somewhere, i don't think your complaint will prosper.

if under investigation pa case mo, just provide all of your proof and explanation to absolve yourself.
