Hello po! This is my first time to seek advice po dito (on behalf of my cousin)

Tanong ko lang po kung legal ba ang ginagawa ng agency nila. Hindi po sila binibigyan ng 13th month pay. Since 2011, nag-aabot lang po sila ng envelop sa mga workers na may laman ranging from 500-1000 pesos. Yun na daw ang 13th month pay nila.

Tapos po, pahinante po ang cousin ko. Ang bayad po sa kanila ay per byahe daw. Madalas 4am po pumapasok at 11pm ang out, pero pag nakaisang byahe lang sa loob ng mahabang oras na yun ay pang-isang byahe (sweldo sa isang araw) lang ang binabayaran sa kanila. Nung nagababasa po kasi ako sa mga posts dito, service rendered after 8 hours ay considered OT na. Ibig sabihin po ba ay dapat binabayaran ung oras nila na sobra sa 8 hours? O mayroon pa pong ibang exemptions na pwedeng hindi bayaran ng agency ung mga ganitong cases?

Kung sakaling mali po ang ginagawa ng agency, tulungan nyo naman po ang cousin ko kung ano ang steps-by-steps na gagawin.

Sa 13th month pay, dapat i compute ang sahod ng cousin mo sa buong taon then divided by 12, yun ang dapat niya makuha. parang masyadong maliit ang yung 500-1000 pesos.


Sa OT Pay: pwede siyang maiconsider sa excempted because of being a field personnel

Field personnel, if they regularly perform their duties away from the
principal or branch office or place of business of the employer and
whose actual hours of work in the field cannot be determined with
reasonable certainty

they are not covered under premium pay.
