good day ask ko lang po may kinuha pong bahay ung pinsan ko sa duraville realty in cavite nakapagreserved na po ng 20k then habang nagbabayad ng equity worth 171k nilalakad na po requirements ang problem po nung nagpareserved tinanong po namin kung pwede po divorced sa u.s pwede daw so pina consularized na nung fully paid na kami sa equity sakto papasa na ng mga requirements tska sasabihjn kelangan daw cenomar then hindi daw pwede pag hindi annulled dito sa pinas. panay padagdag ng mga requirements kaya nawalan na ng gana yung pinsan ko na kumuha ng housing loan kaya nirerefund nlng namin then sabi 20k lang daw makukuha sa refund. may laban po ba kami na marefund ang equity na binayad namin kasi hindi pa naman po nasubmit ang requirements and d pa po turnover or process kahit sabihin po nila na nagrerely aila sa no refund policy nila hndi po namin gusto icancel pero mukhang wala din mapupuntahan kung ipilit namin ung bahay please advice po thank you

Hello po,

First, your cousin has to show that he/she is not Filipino when he/she got divorced (since divorce is not legal for Filipinos). Second, only Filipinos can buy land here in the Philippines. So, your cousin’s situation is complex.

Now that’s out of the way, regarding the refund, have you given the equity equivalent to 24 months? If so then your cousin is eligible to get 50%. If not, then your cousin only gets a grace period.

Tanong ko lang po if pwede pa po marefund yung money na binigay ng boyfriend ko sa agent issuing only a hand written receipt as reservation po yung P2, 500.00? Kukuha po sana sya ng rent to own na house and lot via Pag-IBIG financing, kaya lang po may medical condition po sya na kailangan unahin kesa panghulog sa equity nung bahay, kaya mgbaback-out na po sya, kaya lang po non-refundable daw po yung pera kasi based daw po sa agreement yun. Wala pa din po kami napapasa na kahit anong documents sa knila, may pinapirmahan lang po na reservation agreement.

Wala pa po binibigay yung broker/agent na kung anong phase, block no/unit no. kung alin po ba yung pinareserve kasi sold out na daw po yung mga unit, waiting pa daw po yung sa kanya, magaantay pa daw pong may mag open house.

yung project na phase 2 po nila is hindi pa po nasisimulan, wala pa pong house na nakatayo, in short up to this time there is no unit that have been reserved for me yet. Dahil nga po sa health condition ng boyfriend ko, nagdecided po kame not to pursue the purchasing.

Can you please advise me if I can insist for a refund? Kasi unofficial din po yung receipt na binigay nila. Parang acknowledgement receipt lang po sya na hand written.

Parang unofficial receipt po ang binigay sa inyo. Pls insist on gettin your refund. Kung may official receipt po yan, hindi refundable ang reservation fee.
