Hi,

I'd like to seek advise regarding this matter. I am working as a rank and file sa BPO industry but has a workload similar to a supervisor [naka line-up for promotion]. We [with my colleagues] usually rendered OT for admin task like reviews for the day, game plan for tomorrow, meetings, etc. They usually paid our OT but suddenly, there was an escalated email from the finance officers that the gross margin for the income of the LOB (client) dropped to an unexpected numbers and one that causes the problem was the salary expenses for everyone (from level 1 agent post up to the supervisor post).

Seasonal lang kasi yung account where in its the down season and we are receiving less volume of calls vs the number of heads taking in calls (most BPO get their income from their client based on the number of incoming calls).

Now, they informed us that they will remove all the OT rendered from the last payout (na nabayaran na) then it will be deducted to the next payout while in the other hand, all OTs rendered for the current payout will be voided. Then iba-backtrack nila yung mga OTs from the last payout kung valid ba or hindi, kung valid, they will pay the valid OTs as an incentive on the next payout. Ang problema, they will considered the valid OTs if it was part of a call - so yung mga hindi nag ca-call like support or supervisors will may not be able to get their OTs back.

Is this something legal? If not, what are the steps that we can do for this?

maaari po kayong lumapit sa DOLE para isangguni yang problema nyo

Alam ko nga dapat hindi pwede eh, pero ibabalik daw in a form of incentive? Pero for valid OTs lang... Meron bang articles or something na documents para sa gantong issue?

Ang valid na OT, ay may nakalaan ng documento (OT Form) na pinayagan at na approve ang inyong OT. Kung "nabayaran" kayo ng OT ng walang document na ito, pwede masabing nag kamali lang ang pag compute ng payroll at binabawi ang sobrang nabigay sa inyo.

sabi nga ni patok, pwede kayong mag reklamo at hayaan ninyo sila mag prove na hindi legal ang OT pay.
