Hi Atty, I just wanna confirm, I filed immediate resignation today and they get my resignation letter but according to them they will still check for it and talk about it. . I will be having my masters degree that's why I decided to resigned. They are still requiring me to go to work for 30 days. And i dont have the plan to go to work. Are they going to file a case for me because of AWOL? BTW atty, Im still in probationary contract. And it is not indicated that there will be an early contract termination fee. DO they file case in DOLe?

Ask ko lang po sa case ko kasi na hired po ako nito lang Aug 7 pero until Aug 14 wala pang turn over sa akin na mga gamit ng dating pinalitan ko training lang kung ano gagawin pero nag resign ako last Aug 15 kasi Hindi ako fit sa position doing inventory na wala exact training ramdam ko na hindi ako tatagal Kay naisip ko mag resign dahil alam ko Hindi ko ma perform ng maayos trabaho ko...immediate din po resignation ko wala po ba silang hahabulin sa akin wala pa naman po sa akin mga papers ng pinalitan ko as in wala pa akong nasimulan ni wala pa akong table trainibg pa lang

hi po, ask ko lang po , 3 days na po ako sa work ko then d nako pumasok ng 2 days kase balak ko na magawol. but tinext ako ng hr namen na magresign nalang ng maayus. so balak ko is magpasa nalang ng resignation letter effective immediately. Ipapa 30days turn over pa po ba ako e 3days palang naman po ako pumapasok?

its up to your employer. Be aware that if you go awol or fail to render 30 days you can be sued for damages

@techno yes, basically ang ibig sabihin ng employer mo is hindi na ni excuse yung pananagutan mo sa danyos dahil sa pag labag mo sa kontrata dahil mag resign ka. hindi ka naman nya pwedeng pilitin by force. pero sa tingin ko plano ka nyang idemanda kaya hindi nya ni "accept" yung resignation mo.
if ayaw mo na talagang magtrabaho dyan, basta ipareceive mo yung resignation mo, padala mo by registered mail kung ayaw nila ireceive. mas mabuti kung maka render ka ng 30 days. bukod kasi sa damages na kelangan bayaran if hindi ka nag render at iba pa yung damages sa hindi pag tupad sa contract. at least isang "damages" lang ang kelangan mong bayaran
