hi sir, need ko lang po ng legal advice regarding my work, 21years na po ako sa aking trabaho. naka gawa po ako ng mali sa transaction ng isang customer namin na nag push nila to file a formal complain against me.. ngayon gusto ko nalang po mag resign (para man lang iwas sa investigation sa pagka mali na yun, dami rin kasi dawit na mga ka trabaho rin namin na iniiwasan ko rin isiwalat) para man lang sakali ma i salba ko pa ang lenght of service ko. nung sinabihan ko yung supervisor ko tungkol sa hiling ko na mag resign, sabi niya na per HR hindi pa daw ako pwede mag resign dahil under investigation pa daw ako. also they are barring me of taking a leave. hope ma bigyan nyo po akong legal advice, kung ano po ang rights ko, at ano po dapat ko gawin? salamat po..

hindi ka nila pwede pigilan magresign but kahit resigned ka na hindi mawawala ang obligation mo sa company kung may damages ka na nagawa.
Ang pagresign mo ay kelangan dumaan parin sa tamang proseso. File ka ng resignation tapos render ka ng required amount of days, then you dont need to report for work na. Clearance may however be withheld pending the results of the investigation
