eto iyong nirevised sa employment contract namin...

"In consideration of the performance of your services, you will receive an hourly rate of 220.00 pesos less applicable taxes and to be paid every 14th and 29th of the month. Cut-off period for timesheet is evry 7th and 22nd of the month."

sa original contract ganito ang nakalagay:

"In consideration for the performance of your services, you will receive a monthly salary of Pho41,946.67 less applicable taxes and paid every 14th and 29th of the month following the completion of the previous timesheet. Timesheet will be for a 14-day period beginning on Saturday and ending on Friday."

may nilalabag ba company namin dyan, iyong monthly salary namin based sa 44 hours per week na pasok, ngayon ginawa na lang 40 hours per week ang pasok namin, ang result lumiit iyong monthly salary namin kung pagbabasehan iyong 40 hours per week at hourly rate?

Department of Labor only recognize Daily Paid and Monthly Paid employees. Hourly paid are usually done by professionals that you pay them for the time they spent with you.

Kung ginawa nila ay from monthly paid employees to daily paid employees kayo, may diminution of benefits agad dahil hindi na kayo mababayaran ng special holiday pay.

mas lalo na sa gagawin nilay na monthly paid to hourly paid. Just ask your HR the reasoning for this.

actually baligtad, if pareho ang rate na binigay, mas mataas ang daily paid kesa sa monthly paid so no dimunition of benefits there. for example 50k ang monthly salary. tapos ginawang daily but 50k din ang total. this means while before you were getting 50k and the special holidays are already paid, so if daily ka na and asked to come in on a special holiday, you get extra

Depende sa situation

i.e. 10k monthly rate. vs 10k total daily rate

26 working days, if in a month there is a 1 special holiday not worked, the monthly paid still get 10k while the daily paid get 9,616.61.

but if the special holiday was worked, the monthly paid would get 10,098.63 while the daily paid would get 10,115.02

lamang ang daily rate kung pumasok ng holiday kasi 130% sya doon while the monthly rate have additional 30% only. pero most of the time special holiday are never worked.

sorry bro but thats not how you compute it. 10k monthly employees are paid a daily wage of 328 while daily paid are given 382. you cant have a "dimunition of benefits" situation na would apply to some months and not to others.
furthermore nothing in what he has show says that he is a monthly paid employee. he only says that his monthly salary is so and so.
will be happy to discuss this with you further but wag na sa thread na ito. dont want to hijack it

actually sir lukekyle, even if our contract states we will receive a monthly salary but in reality we were paid per hour basis. And our HR told us that the monthly salary shows on our contract was computed based on our hourly rate per 44 man hours per week. Now, our real problem is they changed the number of man hours we are supposed to work to 40 hours per week with the same rate as the 44 man hours. With this, our computed monthly salary now will be lesser because of the reduced man hours.
